Inter-State Council (ISC)

Constitutional Status of Inter-State Council

  • The Inter-State Council (ISC) is a Constitutional Body established under Article 263 of the Constitution.
  • It serves as a forum for coordination, consultation and cooperation between the Union and the States, as well as among the States themselves.

Establishment of Inter-State Council

  • Constituted: 28 May 1990
  • Established by: Presidential Order under Article 263.
  • Government: National Front Government headed by Prime Minister V.P. Singh.

Constitutional Basis (Article 263)

The President may establish an Inter-State Council if it appears that such a body would serve the public interest.

The Council may be entrusted with the following functions:

Inquiry & Advice
  • Investigate and discuss disputes that may arise between States.
  • Provide advice on such disputes.
Coordination
  • Examine subjects of common interest between:
    • Union and States
    • Two or more States
Recommendations
  • Make recommendations for:
    • Better policy coordination
    • Administrative cooperation
    • Uniform implementation of national policies.

Composition of Inter-State Council

Chairman

  • Prime Minister of India

Members

Union Ministers
  • Six Union Cabinet Ministers, including the Union Home Minister (generally nominated by the Prime Minister).
Chief Ministers
  • Chief Ministers of all States
Union Territories
  • Chief Ministers of Union Territories having a Legislative Assembly:
    • Delhi
    • Puducherry
    • Jammu & Kashmir
Administrators / Lieutenant Governors
  • Administrators / Lieutenant Governors of Union Territories without a Legislature.

Permanent Invitees

The Prime Minister may invite:

  • Additional Union Ministers
  • Other persons as considered necessary for specific discussions.

Objectives of Inter-State Council

Promote Cooperative Federalism

  • Strengthen Union–State relations.
  • Encourage cooperation rather than confrontation.

Resolve Inter-State Issues

Provides a platform to discuss matters relating to:

  • Water disputes
  • Boundary disputes
  • Internal Security
  • Economic Planning
  • Infrastructure Development
  • Environmental Issues

Policy Coordination

  • Facilitates harmonisation of policies among different governments.

Functions of Inter-State Council

Advisory Function

  • Advises the Union Government and State Governments on matters of common concern.

Consultative Function

  • Acts as a forum for dialogue before disputes escalate.

Coordination Function

  • Coordinates policies relating to:
    • Economic Development
    • Social Welfare
    • Internal Security
    • Centre–State Relations

Investigative Function

  • Studies issues involving multiple States and recommends appropriate solutions.

Nature of Recommendations

  • Recommendations of the Inter-State Council are Advisory.
  • They are not legally binding on the Union or the States.

Meetings Frequency of Inter-State Council

  • There is no constitutional requirement regarding the frequency of meetings.
  • Meetings are held as and when considered necessary by the Government.

Exam Note: Older books mention that the Council meets three times a year. This is not a constitutional or statutory requirement and does not reflect current practice.

Inter-State Council Secretariat

Administrative Support

  • The Inter-State Council Secretariat (ISCS) functions under the Ministry of Home Affairs (MHA).
  • It provides:
    • Administrative assistance
    • Research support
    • Coordination for meetings
    • Follow-up on recommendations

Sarkaria Commission (1983–1988)

Recommendation

  • Recommended the establishment of a Permanent Inter-State Council to strengthen Centre–State coordination.
Outcome
  • Based on this recommendation, the Inter-State Council was constituted in 1990.

Punchhi Commission (2007–2010)

Major Recommendations

  • Strengthen the role of the Inter-State Council.
  • Hold regular meetings.
  • Make it the primary institutional forum for resolving Centre–State disputes.
  • Enhance consultation before major policy decisions affecting States.
